Terms and Conditions

  1. General

The supply of services by Waimak Bins Limited (“Waimak Bins”, “we”, “us”, “our”) is governed by these Terms and Conditions. These Terms may be reviewed and updated at any time.
Commencement of services constitutes confirmation that you have read, understood, and agreed to these Terms and Conditions.

  1. Consumer Guarantees Act 1993

Nothing in these Terms and Conditions limits or excludes any rights you may have under the Consumer Guarantees Act 1993 (CGA), except to the extent permitted by law.

Where services are supplied for business purposes, as defined in the CGA, the protections of the CGA do not apply, and you agree that the CGA is excluded to the maximum extent permitted by law.

  1. Pricing

The price of services is the most recent price quoted to you by Waimak Bins via phone or email. All prices are inclusive of Goods and Services Tax (GST) and are based on the delivery address and collection frequency provided.

We reserve the right to:
• Vary prices at any time
• Charge additional fees for overflowing bins or waste placed beside bins
• Charge additional fees for bins containing heavy materials, including but not limited to dirt, concrete, stones, bricks, wood, and other building materials, due to increased disposal costs

  1. Service Agreement Terms

240 Litre Bin Service
• Minimum contract term: Six (6) months
• Early termination: Cancellation prior to the end of the minimum term may incur a $100 early cancellation fee

660 Litre & 1100 Litre Bin Services
• Contract term: Twelve (12) months
• Collection frequency: Fortnightly (two-weekly) or more frequent
• Early termination: Cancellation prior to the end of the contract term will incur charges equal to the remaining balance of the contract term or $100 early cancellation fee, whichever is the greater 

5. Cancellations

After completion of the applicable contract term, you may cancel your service by providing:
Two (2) weeks’ notice for 240L bins
Four (4) weeks’ notice for 660L and 1100L bins

A cleaning fee of $10.00 per bin may apply if bins are extremely dirty.

  1. Variations

Variations or additions to services are subject to availability and are granted at the discretion of Waimak Bins.

  1. Additional Fees

The standard collection fee will still apply in the following circumstances:

  • The bin is not out for collection
    • The bin is not accessible due to locked gates
  • We attend your property and the bin is already empty

To avoid this charge please advise if collection  is not required.

Extra fees may be charged in the following circumstances:

  • The bin is overweight
  • There is extra rubbish/recycling left beside the bin
  1. Access and Collection

Roadside Collection
Bins must be placed at the roadside by 7:30am on the scheduled collection day unless otherwise agreed. If a bin is not presented, the standard collection fee will still apply.

On-Site Collection
Where on-site collection has been agreed, you are responsible for providing clear, safe, and suitable access for our staff and vehicles, including ensuring access ways are free of obstructions such as low-hanging branches, animals are contained and ideally gates are open.
You may be charged for any damage to vehicles caused by unsuitable access. If on-site collection is attended and the bin does not require emptying, the standard collection fee will still apply.

Damage Disclaimer
We accept no responsibility for damage to surfaces, underground services, pipes, cables, or fixtures located beneath or across access ways.

  1. Use of Bins and Risk

You are responsible for the bin while it is in your possession, subject to fair wear and tear and must report any broken/damaged bins as soon as you are aware of it.

You must not:

  1. Light fires in or place hot ashes into the bin
  2. Place liquids, dirt, hardfill, animal carcasses, or hazardous, toxic, explosive, or noxious materials (including asbestos, solvents, oils, batteries, or liquid concrete) into the bin
  3. Overfill bins or load them in a manner that causes spillage
  4. Move bins to another address without our consent

You will be liable for damage to bins resulting from misuse.

  1. Invoicing and Payment

Invoices are issued monthly for the previous month’s collections and may be sent by mail or email. Payment is due 10 days from the invoice date unless otherwise agreed.

  1. Late Payments 
  1. We reserve the right to suspend or cancel services for overdue accounts.
  2. A 2% monthly fee may be applied to overdue balances.
  3. Unpaid debts may be referred to a debt collection agency, at which time you will become liable for all associated costs.
  4. Bins may be removed from your property.
  5. If we are unable to recover the bins, replacement costs will be added to your account.

12. Privacy

We collect and use personal information to provide services, manage accounts, and process payments. You may request access to or correction of your personal information.
We take reasonable steps to protect personal information from misuse, loss, or unauthorised access.
